2. Applicability
These terms apply to all offers made by The Quiet Club and to any distance agreement with consumers in the Netherlands and Belgium. Any deviations are only valid if confirmed by us in writing. Our privacy policy, shipping policy, and return/refund policy form an integral part of these terms.
3. Offer and Information
Product images are for illustration purposes only. Colors may vary depending on your screen. Obvious typographical or pricing errors are not binding. Each offer includes a clear product description, the total price including VAT (where applicable), any additional costs, and the estimated delivery time.
4. Prices and Payment
All prices are listed in euros and include VAT where applicable. Shipping is free. Available payment methods at checkout include iDEAL, Bancontact, Visa, Mastercard, and Apple Pay (via Shopify Payments). Orders are processed once payment has been successfully completed.
5. Ordering and Agreement
An agreement is formed once you complete your order and receive a confirmation email from us. Please review your order details carefully before completing your purchase. We reserve the right to refuse or cancel orders in cases of clear errors or suspected misuse or fraud.
6. Delivery and Risk
Processing time: 1–2 business days (no processing on weekends or public holidays).
Shipping: via DHL, PostNL, or DPD. The carrier is selected automatically based on destination and availability.
Origin: orders are shipped from our overseas warehouse in China.
Delivery time after dispatch: approximately 6–11 business days.
Total estimated delivery time (processing + shipping): approximately 7–13 business days.
The risk of loss or damage remains with us until your order has been delivered to the address provided. Collection and scheduled delivery options are not available.
7. Right of Withdrawal (30-Day Return Period)
You have the right to return your order within 30 days from the day after delivery, without providing a reason. You may handle the product as you would in a physical store.
Our international warehouse is located in China. Returns can only be sent to this address.
Return conditions: items must be unworn, undamaged, and complete, preferably in their original packaging with all labels and tags attached.
To initiate a return, contact us within 30 days at info@the-quietclub.com with your order number. You will receive return instructions, the correct return address, and/or a return label via email (RMA process).
Once we have received and inspected your return, we will issue a refund within 7 business days using the original payment method. If applicable, outbound shipping costs based on the standard rate will be reimbursed in line with EU regulations. If shipping was free, no amount will be refunded for shipping. Return shipping costs are the responsibility of the customer, unless the return is due to our error (such as a defective, damaged, or incorrect item).
8. Returns, Exchanges, and Exceptions
We do not offer exchanges. If you would like a different size, color, or item, please return your order for a refund and place a new order.
Exceptions: personalized or custom-made items (if applicable) are excluded from the right of withdrawal, unless there is a manufacturing defect.
9. Conformity and Legal Warranty
We guarantee that our products meet the terms of the agreement and reasonable expectations. If a product does not conform, you are entitled to repair or replacement, or if that is not possible or reasonable, a full or partial refund. Your statutory rights remain unaffected.
10. Liability
Our liability is limited to the value of the relevant order, unless the damage is caused by intent or gross negligence, or where mandatory law requires otherwise. We are not liable for indirect damages such as consequential losses, loss of profit, or data loss. This limitation does not apply to personal injury.
11. Force Majeure
In the event of force majeure, including but not limited to natural disasters, epidemics, war, strikes, fire, government actions, carrier disruptions, or failures of internet, hosting, or suppliers, we reserve the right to suspend or terminate the agreement without liability for damages.
12. Fraud and Abuse Prevention
To protect both our customers and our business, we may review orders for unusual patterns. If fraud is suspected, we may request additional verification or cancel the order.
13. Promotions, Vouchers, and Gift Cards
Promotions and discount codes are temporary and cannot be combined unless stated otherwise. Terms may vary per promotion and will be communicated accordingly. Gift cards cannot be redeemed for cash.
14. Reviews and User Content
By submitting a review or sharing content (such as photos), you grant The Quiet Club a non-exclusive, worldwide, royalty-free license to use, reproduce, and publish this content for marketing and improvement purposes. We reserve the right to remove content that is unlawful or violates our guidelines.
15. Privacy and Cookies
We handle personal data with care. Please refer to our privacy policy and cookie information on the-quietclub.com for more details on how we process your data, your rights, and your cookie preferences.
16. Complaints and ODR
We aim to respond to complaints within 24 hours. Please submit your complaint via info@the-quietclub.com including your order number and a clear description.
If we are unable to reach a solution, you may use the European Commission’s ODR platform: https://consumer-redress.ec.europa.eu/index_en
17. Applicable Law and Jurisdiction
These terms and all agreements are governed by Dutch law, while respecting mandatory consumer protection laws in your country of residence within the EU. Disputes will be submitted to the competent court in the Netherlands. As a consumer, you also have the right to bring a dispute before the court in your place of residence.
18. Changes
We may update these terms from time to time with future effect. The most recent version will always be available on our website. In the case of significant changes, we will inform you accordingly.
