Applicability
These terms and conditions apply to every offer from The Quiet Club and to every distance contract with consumers in the Netherlands and Belgium. Deviations are only valid if confirmed by us in writing. The privacy policy, shipping policy and return/refund policy are an integral part of the agreement. -
Offer and information
Product images are for illustration purposes; color representation may vary per screen. Obvious typing or pricing errors do not bind us. Each offer contains a clear description of the product, the total price including VAT (where applicable), any additional costs and the expected delivery time. -
Prices and payment
All prices are in euros and, where applicable, include VAT. Shipping costs: free. The available payment methods at checkout are iDEAL, Bancontact, Visa, Mastercard and Apple Pay (via Shopify Payments). The order will be processed after payment has been confirmed. -
Ordering and formation of the agreement
The agreement is concluded when you complete the order and we confirm it by e-mail. Check your order details carefully. We may refuse or cancel an order in case of clear errors, suspicion of misuse or fraud. -
Delivery and transfer of risk
Processing time: 1–2 business days (no processing on weekends/holidays).
Shipping: with DHL, PostNL or DPD; the carrier is automatically chosen based on destination and availability.
Origin: shipment from our overseas warehouse in China.
Delivery time after processing: an average of 6–11 business days.
Total average delivery time (processing + shipping): approximately 7–13 business days.
The risk of loss or damage rests with us until the moment of delivery at the address you provided. Pick-up and delivery appointments are not available. -
Right of withdrawal (cooling-off period) – 30 days
You have a 30-day cooling-off period from the day after receipt to withdraw without stating reasons. You may handle the product as you would in a store.
Our international warehouse is located in China. We can only accept returns at this address. Conditions for return: unworn, undamaged and complete; preferably in the original packaging with all labels/tags.
Exercising the right: report your return within 30 days via info@the-quietclub.com with your order number. You will receive the return instructions, the correct return address and/or label (RMA process) by e-mail.
Consequences of withdrawal: after receipt and inspection, we will refund the purchase amount within 7 business days via the same payment method. Any outward shipping costs according to the standard rate will be reimbursed according to EU rules; in case of free shipping, this amount is nil. Return costs are for the customer, except in case of our fault (e.g. defective/damaged/incorrectly delivered). -
Returns, exchanges and exceptions
Exchanges are not possible. If you want a different size/color or an alternative item, return your order for a refund and place a new order.
Exceptions: personalized or custom-made products (if applicable) are excluded from the right of withdrawal, unless there is a manufacturing defect. -
Conformity and legal warranty
We guarantee that products comply with the agreement and with reasonable expectations. In case of non-conformity, you are entitled to repair or replacement, or – if not possible or reasonable – (partial) refund. Your legal rights remain applicable at all times. -
Liability
Our liability is limited to the amount of the relevant order, unless the damage is the result of intent or deliberate recklessness or when mandatory law dictates otherwise. We are not liable for indirect damage such as consequential damage, lost profit or data loss. This limitation does not apply to personal injury. -
Force majeure
In case of force majeure (including, among other things, natural disasters, epidemics, war, strikes, fire, government measures, disruptions at carriers, internet/hosting failures or suppliers), we are entitled to suspend performance or dissolve the agreement without compensation. -
Fraud and abuse prevention
To protect customers and our company, we may check orders for unusual patterns. In case of suspected fraud, we may request additional verification or cancel the order. -
Discount promotions, vouchers and gift cards
Promotions and discount codes are temporary and cannot be combined, unless stated otherwise. Conditions may vary per promotion and will be communicated with the promotion. Gift cards cannot be exchanged for cash. -
Reviews and user content
By posting a review or sharing content (e.g. photos), you grant The Quiet Club a non-exclusive, worldwide, royalty-free license to use, copy and publish that content for marketing and improvement purposes. We may remove content that is unlawful or violates our guidelines. -
Privacy and cookies
We handle personal data with care. Consult our privacy policy and our cookie information on the-quietclub.com for details about data processing, your rights and cookie preferences. -
Complaint handling and ODR
We strive to respond to complaints within 24 hours. Submit your complaint via info@the-quietclub.com with your order number and a clear description.
If you cannot find a solution, you can contact the ODR platform of the European Commission: https://consumer-redress.ec.europa.eu/index_en -
Applicable law and competent court
Dutch law applies to these terms and conditions and to all agreements, with due observance of mandatory consumer protection law in your EU country of residence. Disputes will be submitted to the competent court in the Netherlands. As a consumer, you retain the right to submit a dispute to the court of your place of residence. -
Changes
We may change these terms and conditions with effect for the future. The most recent version is always available on our website. In case of significant changes, we will inform you appropriately.
